TERMS OF SERVICE
Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ten2ten.io website and customer payment portal at pay.ten2ten.io (the "Service") operated by TEN2TEN, INC. ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. ACCOUNTS
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. PAYMENT TERMS
The Service allows you to view invoices, make payments, and, where available, save payment methods through our secure payment processors for future transactions.
2.1 Payment Methods
We accept various payment methods, including credit and debit cards. By providing a payment method, you represent that you are authorized to use the designated payment method and that any payment information you provide is true and accurate.
2.2 Saved Payment Methods
If you choose to save a payment method for future transactions, your payment information is collected and processed by our PCI-compliant payment processors. TEN2TEN does not store full card numbers or CVC/CVV codes on its own servers. We may retain limited payment-related details made available by our processor, such as card brand, last four digits, expiration month/year, billing address, invoice history, and payment status, for billing, fraud prevention, customer service, and recordkeeping purposes.
By choosing to save a payment method, you authorize the secure storage of your payment method by our payment processor and the use of that saved payment method for future transactions that you approve.
2.3 Payment Processing
All payments are processed through secure third-party payment processors that comply with PCI DSS standards. By making a payment through our Service, you agree to be bound by the payment processor's terms of service and privacy policy in addition to these Terms.
Payment transactions are encrypted and securely processed. While we take precautions to protect your payment information, we cannot guarantee that unauthorized access to your information will never occur.
2.4 Failed Payments
If a payment fails, you remain responsible for any amounts due. We may retry failed payments and/or contact you for alternative payment arrangements.
3. CUSTOMER PORTAL
The Service provides access to a customer portal where you can view your invoice history, pending invoices, and make payments. You are responsible for maintaining the confidentiality of your portal access credentials.
You agree that information displayed in your customer portal is accurate to the best of our knowledge. If you believe there is an error, you must notify us promptly.
4. INTELLECTUAL PROPERTY
The Service and its original content, features, and functionality are and will remain the exclusive property of TEN2TEN, INC. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TEN2TEN, INC.
5. USE RESTRICTIONS
You agree not to:

Use the Service in any way that violates any applicable national or international law or regulation;

Attempt to probe, scan, or test the vulnerability of our systems or networks or breach any security or authentication measures;

Attempt to access any user accounts or private data other than your own;

Use any automated means or interface not provided by us to access the Service or extract data;

Use the Service in any manner that could disable, overburden, damage, or impair the Service; or

Use the Service for any fraudulent or illegal purpose.
6. TERMINATION
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. DISCLAIMER
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
TEN2TEN, INC., its subsidiaries, affiliates, and licensors do not warrant that:
- a) the Service will function uninterrupted, secure or available at any particular time or location;
- b) any errors or defects will be corrected;
- c) the Service is free of viruses or other harmful components; or
- d) the results of using the Service will meet your requirements.
8. LIMITATION OF LIABILITY
In no event shall TEN2TEN, INC., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- (i) your access to or use of or inability to access or use the Service;
- (ii) any conduct or content of any third party on the Service;
- (iii) any content obtained from the Service; and
- (iv) unauthorized access, use or alteration of your transmissions or content,
whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. INDEMNIFICATION
You agree to defend, indemnify and hold harmless TEN2TEN, INC. and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
- a) your use and access of the Service, by you or any person using your account and password;
- b) a breach of these Terms; or
- c) content posted on the Service.
10. GOVERNING LAW AND VENUE
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of those courts.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
11. CHANGES
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
12. COOKIES
The Service uses cookies, including those from third-party payment processors, to facilitate secure payment transactions and improve your experience. By using our Service, you consent to the use of cookies as described in our Privacy Policy.
13. DATA SECURITY
We implement reasonable security measures to protect the security of your information. However, please be aware that no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against interception or other types of misuse.
When processing payments, we adhere to Payment Card Industry Data Security Standard (PCI DSS) requirements. All payment transactions are processed through secure payment processors that are PCI-compliant. Payment information is collected and processed by our PCI-compliant payment processors. TEN2TEN does not store full card numbers or CVC/CVV codes on its own servers.

14. PAYMENT METHODS
We accept the following payment methods: Visa, Mastercard, American Express, and Discover. All prices on our site are listed in United States Dollars (USD).
By using our payment services, you agree to comply with all applicable card network rules, including the Visa Rules and Regulations, the Mastercard Rules, and the American Express Merchant Operating Guide.
15. FULFILLMENT POLICIES
15.1 Refund Policy
For studio services: Deposits for booked studio time are non-refundable, but may be applied to a rescheduled session if notice is provided in accordance with our cancellation policy. Completed recording, production, mixing, mastering, and other services already rendered are non-refundable.
For digital services, if any are expressly identified on your invoice or in a written agreement: "digital services" means licensed software, software access, SDK access, platform access, or other digital deliverables specifically described in the applicable invoice or written agreement. Refund requests for those digital services must be submitted in writing to business@ten2ten.io with your order details and reason for the refund. Unless otherwise stated in writing, refund eligibility for such digital services is limited to requests made within 30 days of purchase and only before the applicable digital service has been fully delivered, activated, materially used, or completed.
15.2 Cancellation Policy
For scheduled sessions and appointments: Cancellations must be made at least 24 hours in advance unless a different notice period is stated on your invoice, booking confirmation, or written agreement. Late cancellations may result in cancellation fees or forfeiture of any deposit paid.
For project-based services: Cancellation requests must be submitted in writing. If work has already begun, you remain responsible for payment for work performed up to the cancellation date and for any non-refundable third-party costs already incurred on your behalf.
15.3 Billing Disputes
Billing Disputes. If you believe a charge was made in error, you must contact us at business@ten2ten.io or 786.408.0174 before initiating a chargeback so we can review and attempt to resolve the issue. Please include your invoice number, payment date, amount, and the reason for the dispute. We will acknowledge billing disputes within 2 business days and will work in good faith to resolve them promptly.
